Ben Freeman: Accused of rape

Tuesday October 14,2008

By John Chapman

FORMER Emmerdale star Ben Freeman was seen cuddling a girl minutes after he had allegedly raped her, a court heard yesterday.

A fellow guest at the Barbados hotel described how he walked in on them as they “seemed” to be having sex and the 16-year-old did not raise an alarm.

Sales consultant James Broughton told the High Court in the island’s capital Bridgetown: “I was sitting with my friend and we heard noises coming from about 15 metres away – noises of a pleasurable nature.”

Mr Broughton admitted he had recognised Freeman and taken pictures of the couple, which he sold to a newspaper for £1,500.

He told the court he was not aware of the rape charges until two days after he had sold the pictures.

Mr Broughton told the court that he saw Freeman lying on top of a girl on a sun lounger and it seemed as though they were having “intercourse”.

Asked by defence lawyer Anesta Weekes: “At any stage did you hear her scream ‘Stop’?” he replied: “Not at all.”

He said he was surprised, given that it was a “family resort” and an “open place with plenty of light”.

Asked whether Freeman was cuddling the girl or trying to protect her identity, Mr Broughton said that “to a certain extent” it could be the latter.

Freeman, 28, denies raping the girl in November 2006. The court heard he told a police officer they had sex but it was “consensual”.
